Your petitioner respectfully represents that he is a Surety to the Bond of Albert Carrington one of the Executors of the last Will and Testament of the said deceased and that he desires to be released from all responsibility on account of all future acts of the Said Albert Carrington as one of the Executors as aforsaid

To the Hon. Elias Smith Judge of said the Probate Court in and for said County
We the undersigned, most respectfully represent:
That Brigham Young late of Salt Lake City, County of Salt Lake, Territory of Utah did in said city August 29th 1877 leaving a last will which was duly admitted to probate 19th day of September 1877, and by which he appointed George Q. Cannon, Brigham Young and Albert Carrington as the executors thereof that afterwords to wit, Oct. 6th 1877 The said Brigham Young qualified as such and gave bonds for the faithful performance of his duties in the sum of one hundred thousand dollars, on which said bond the undersigned became and are his sureties; and it is provided in Section 78 of "An act regulating procedure in probate courts", approved February 18, 1876, that when either or all, of the sureties of an executor or administrator shall desire to be released from responsibility, on account of his future acts, they may make application to the probate court or judge for relief, and the court or judge shall cause a citation of the executors or administrators to be issued requiring them to appear at a time

and place to be therein specified and to give other security.
Now therefore in consideration of the premises and the fact that we do not wish to be held for any future acts of said Brigham Young as executor or trustee under said will, we ask that we be released from said bond, and that a citation be at once issued and secured in the said executor requiring him to appear and give new sureties within five days, and further that he be required to do no act or thing as such executor or trustee till after we are released from said bond.
