COUNCIL CHAMBER, October 27, 1916.

A special meeting of the Council was held on this date at 5 o'clock P. M. to consider ordinance and any other matter in reference to City Manager and Engineer, and an ordinance in reference to sidewalks. Also in reference to gas and water pipes in streets where Southern Railway Company is laying macadam.

There were present Messrs. Forrest, Graves, Long, Souder, Twyman and Wingfield.

AMENDMENT TO CHAPTER 12. IN RE. CITY MANAGER AND ENGINEER. An ordinance entitled "An Ordinance amending Chapter 12. sections 129 to 132 inclusive, re-enacting the same as follows: The title to chapter 12 shall be as follows; City Manager and Engineer", adopted at a meeting of the Board of Aldermen at a meeting October 24, 1916, was taken up, read section by section, being so adopted and then unanimously adopted as a whole. (See Ordinance Book #1 for copy.)

SPECIAL COMMITTEE ON SELECTION OF CITY MANAGER AND ENGINEER. On motion of Mr. Twyman a Special Committee consisting of Messrs. Twyman, Forrest and Wingfield, was appointed by the chairman to confer with a similar committee from the Board of Aldermen for the purpose of examining credentials of applicants for Business Manager and Engineer; recommend salary, etc.

DEFERRED The matter of amending the resolution fixing the price at which the city will lay sidewalks for abutting property owners was referred to the Street and Ordinance Committees.

GAS, WATER & SEWER MAINS AND SERVICES ON STREETS TO BE MACADAMIZED BY SO. RY. CO.

APPROPRIATION FOR SAME MADE. His Honor, the Mayor, stated to the Council that the Southern Railway Company was making preparations for laying the macadam on those streets required to be macadamized under a contract with the City, and that it had been thought wise to to lay the necessary water, sewer and gas mains in said streets before the macadam was laid; that part of said territory to be piped was in the newly annexed section of the city. The Superintendent of Water & Sewers reported that it would cost $1,725.30 to lay the water mains and services, $3,185.30 to lay the sewer mains and services, and the Superintendent of Gas reported that it would cost $1,460. to lay the necessary gas mains and services. After a full discussion of the matter Mr. Twyman offered a resolution carrying into effect the proposed improvement, together with the appropriation of the amounts set out, which was adopted unanimously. The meeting then adjourned.

COUNCIL CHAMBERS, November 9, 1916.

The regular monthly meeting of the Council was held on this date with the following members present; Messrs. Elliott, Forrest, Gleason, Graves, Long, Souder, Twyman and Wingfield.

The reading of the minutes was passed by, awaiting the arrival of the new record books.

IN RE. RELOCATION OF LYMAN STREET. The action of the Board of Aldermen in the matter of relocation of Lyman St. referring same to Ordinance Committee to draw an ordinance making the change as requested, was concurred in.

RUGBY ROAD BRIDGE. A communication from His Honor, the Mayor, was received, calling attention of the body to the condition of the bridge over the C & O Ry. near the University Athletic Grounds, saying that his attention had been called to same by Mr. W. C. Thacker, Superintendent of bridges for Albemarle County who said that same should be replaced by a new bridge. The matter was referred to the Street Committee and City Attorney to investigate and report.

REFERRED. A communication was received from J. G. Carter, offering a piece of land on Rugby Road for cemetery purposes. Same was referred to Cemetery Committee.

IN RE. GRADING WEST HIGH & ALTAMONT STS. A petition from citizens in vicinity of High and Altamont Streets asking that the hill at that point be graded, was referred to the Street Committee with power to act.

WOOLENMILLS SIDEWALK. Petition from citizens of the Woolen Mills section, asking that the City join them in laying a cinder or other sidewalk to the city, was referred to the Street Committee to investigate and report.

DR. FULTON'S BILL FOR ATTENDING F. J. PAOLI. REFERRED. Bill of Dr. J. Fulton Williams for medical attendance upon F. J. Paoli, hurt in recent fire, was referred to the Finance Committee to report back.

POLICE. Report of the Chief of Police for October showed cash fines $189.75, cases sent to jail in default, $72/00.

APPROPRIATION FOR BOOKLET. A communication was received from the Secretary of the Chamber of Commerce asking that the appropriation of the sum of $333.33, appropriated in April, 1916, for the purpose of joining the County and University in getting out a descriptive booklet of this section, be now made available.

On motion of Mr. Graves a resolution was adopted making said sum available. (See Ordinance Book #1).

APPROPRIATION FOR CEMENT MIXER. A motion to appropriate the sum of $210. for the purpose of purchasing a concrete mixer for the Street Department, offered by Mr. Wingfield, Chairman, was unanimously adopted. (See Ordinance Book #1).

IN RE. WORK IN ANNEXED TERRITORY -- SEPARATE ACCOUNT OF SAME. The following offered by Mr. Twyman, was unanimously adopted;

RESOLVED BY THE COMMON COUNCIL. THE BOARD OF ALDERMEN CONCURRING, THAT any of the several departments of the City, doing work in the "Annexed Territory", are hereby requested and instructed to keep an accurate itemized account of the cost of all such work in "Annexed Territory" so that the Auditor may make a charge to an account to be known as the "Annexed Territory Improvements".

APPROPRIATION REPORT OF UNIVERSITY AVENUE. A motion by Mr. Twyman to appropriate the sum of $500. to repair university Avenue from the corner of 14th and Main to the bridge over the C & O Ry. at Athletic grounds, was unanimously adopted. (See Ordinance Book #1).

REPEAL OF SEC. 219a OF CITY CODE. The Common Council concurred in the action taken by the Board of Aldermen at its meeting October 31, repealing sec. 219a of the City Code adopted August 11, 1910, entitled Sec. 219a. Police Examining Board. (See Ordinance Book #1.)

SALARY OF CITY MANAGER AND ENGINEER. A motion by Mr. Twyman to fix the salary of the Business Manager and Engineer at $2,000. per annum, payable monthly, was unanimously adopted. (See Ord. Book #1)

IN RE. PRICE FOR LAYING SIDEWALKS. A motion by Mr. Long to fix the price of laying sidewalks at 90 cents per sq. yd., the property owner to pay two-thirds of same, except where unusual grading might be required, was adopted. (Aldermen did not concur).

On motion the meeting then adjourned.

COUNCIL CHAMBER, December 14, 1916. The regular monthly meeting of the Common Council was held on this date at the regular hour with the following members present; Messrs. Elliott, Forrest, Gleason, Graves, Long, Souder, Twyman and Wingfield.

The minutes of all the meetings, both regular and special, held since Sep. 25, 1916, were read and approved.

The following communication was read from his Honor, the Mayor:

MAYOR'S MESSAGE IN RE. STREET LIGHTS IN NEWLY ANNEXED TERRITORY. December 14, 1916 To the President and members of the Common Council.

Gentlemen: In a recent conversation with Dr. Forrest, he suggested that the Lighting Company might be willing to install lights in our newly annexed territory and wait until we collect the taxes of 1917 from this territory for the money for these lights. I was impressed with the idea, and at once took the matter up with Mr. Livers, the Sup't of the company, and he then took it up with his company; He reported to me that his compnay was willing to carry out the above suggestions, if the Council and Board of Aldermen so desired.

In view of the fact that under the decree of the Court, we will have no money to spend in this new territory until the taxes of 1917 are collected and the further fact, that some of the public thoroughfares are not in good condition, and in the dark, it is hard for one to pick his way.

I hope you may see your way clear to light such highways as have already been adopted, and such other streets and avenues as we should adopt as public highways. This plan appeals to me, and I trust it may to you.

REPORT OF BUSINESS MANAGER. The Business Manager, Hon. E. G. Haden, submitted his report for the quarter showing appropriations, $63,117.21; Expenditures, $67,761.77.

HEALTH. The Health Officer submitted his report for November, showing the City to be in very good condition. The following, offered by Dr. Forrest, was adopted:

REFERRED. Resolved, by the Common Council, the Board of Aldermen concurring, That the Street Committee be and hereby are instructed to act upon the proposals by the Christian Church to relocate and lay new walks before its property on Market Street., and that said committee shall investigate and report back upon the Church's claim that the City should bear all the cost of such improvements on the alleged ground that the City paid the total costs in the case of the First Baptist Church some years ago.

The following, offered by Dr. Forrest, was adopted:

REFERRED. Be it Resolved, That all questions pertaining to the City's claims for sewer tax against residents upon Preston Heights and elsewhere within the recently annexed territory, and all questions pertaining to claims against the City on account of private sewers and water lines within such territory, be and hereby are referred to the Finance Committee and the City Attorney for investigation and recommendation to the Council, and that pending such action the special City Attorney suspend any further action against residents held liable for such sewer tax.

REPORT OF THE GAS COMMITTEE. Report of the Gas Committee: December 14, 1916. To the President and Members of The Common Council.

Gentlemen: At a meeting of the Gas Committee, held November 20 1916, the following resolution was adopted:

"Whereas the Board of Aldermen has passed a resolution directing that the Superintendent of Gas be directed not to hire any more conveyances for the transportation of himself and his employes in the prosecution of the work of his department; and Whereas the action if made effective by the concurrence of the Common Council would handicap the Superintendent in the important work he is doing with acknowledged efficiency, therefore, RESOLVED, That the Gas Committee urges the Common Council to refuse to concur in the action of the Board of Aldermen."

We would also recommend that a small truck be purchased for the use of the gas department for the purpose of facilitating the Superintendent in the prosecution of his work by giving him a quick means of conveyance over the city, and for the use of hauling tools and men from place to place.

The Gas Committee desires to go on record as endorsing and approving the administration of the Superintendent of Gas, Mr. H. M. Hantzmon, and to pledge to him our best support in every effort to extend and improve the consumption of gas in our city.

The following offered by Mr. Elliot, was adopted:

COUNCIL'S NON-CONCURRENCE IN ACTION OF ALDERMEN IN MATTER OF LIVERY FOR GAS DEPARTMENT. RESOLVED, By the Common Council, That the action of the Board of Aldermen at their meeting November 13, 1916, directing the superintendent of Gas not to hire any more conveyances for the transportation of himself or his employes in the prosecution of the work of his department, be not concurred in.

REFERRED. Recommendation of the Committee to purchase a truck for the Gas Department, was referred to the Finance Committee to report back.

NOMINATIONS FOR APPOINTMENT AS ASSISTANT CITY GAME WARDENS. Upon the recommendation of R. W. Durrette, City Game Warden, Messrs. L. R. Payne and B. P. Sinclair were nominated to the State Game Commissioner for appointment as Assistant Game Wardens for the City.

REFERRED. A petition was presented from members of the City Police Force asking for an increase in salary to meet the increased cost of living. Same was read.

REFERRED. The bills of the University Hospital against the City for diphtheria patients treated during the Summer School, amounting to $382.48, were referred to the Finance Committee for investigation and report.

REFERRED. Several petitions were presented asking for street lights, which were referred to the Gas & Light Committee with power to act.

REFERRED. The communication from Captain H. Clay Michie, Chairman of the Albemarle Pention Committee, calling attention of the City to the condition of the veteran Mr. Jeff. Wheeler, was referred to the Public Safety Committee.

REFERRED. The bill of Bobby Mainfort for treatment of F. J. Paoli amounting to $25, was referred to the Finance Committee to report.

REFERRED. Application of S. Briggs for permit to erect gasoline tank at his place of business on Water Street, was referred to the Street Committee with power to act.

REFERRED. Application of L. W. May for reduction of license tax on Loan Companies was referred to the Finance Committee to report back.

REFERRED. Application of the Fire Department for 1500 feet of hose was referred to the Public Safety Committee for report.

The following offered by Mr. Twyman, was unanimously adopted;

SALARY OF ACTING BUSINESS MANAGER. Whearas the Mayor, on October 6th, at the request of the Council, assumed the duties of the Business Manager until an engineer and manage could be elected, therefore, be it RESOLVED, That he be paid monthly at the rate of $50 for his services.

The following, offered by Mr. Long, was adopted:

DEED TO BE EXECUTED TO F. D. BROCKMAN'S ESTATE FOR SECTION IN CEMETERY. Whereas it appears to the satisfaction of the Cemetery Committee from the statements of H. C. Chaplin that the balance of $11. which appears from the books to be still due on the quarter section in Maplewood Cemetery, purchased by F. D. Brockman in August, 1875, has in fact been fully paid, therefore be it RESOLVED, That the Mayor be and he is hereby authorized and directed to convey said quarter section to F. D. Brockman's estate by a proper deed, and the Auditor is directed to credit F. D. Brockman's estate account by the $11. balance.

The following resolutions were adopted and will be found spread at length on the Ordinance Book:

QUARTERLY APPROPRIATION. Appropriation of $62,257.38 covering the requisitions of the Business Manager for the ensuing quarter;

TRUCK FOR STREET COMTEE. Authorizing the Street Committee to purchase a truck and appropriating the sum of $400. for that purpose;

CINDER WALK ON E. MARKET ST. Directing that a cinder walk be laid on East Market Street;

INCREASE SALARIES POLICE FORCE. Increasing the salary of the Police force:

APPLEBERRY CASE COMPROMISED. Appropriating the sum of $2,292.14 to settle compromise in suit of Appleberry Vs. City.
