Order of Board of Commissioners on Report of Commissioner on Streets and Public Grounds concerning the construction of Cement Curbings on Hemphill Street from the crossing of said street by the south line of Magnolia Street to the south boundary limits of the City of Fort Worth and requiring abutting property owners to comply herewith.

The report of Commissioner Davidson, recommending the construction of cement curbins on Hemphill Street from the crossing of said street by the south line of Magnolia Street to the south boundary limits of the City of Fort Worth, coming on to be heard, the Board of Commissioners upon consideration thereof and of their own motion this day decided to consider and did consider the necessity and advantage of ordering the construction of curbings on both the east and west side of Hemphill Street the same being a public thoroughfare from a point where the south line of Magnolia Street crosses Hemphill Street south to a point where the south boundary of the corporate limits of the City of Fort Worth crosses the said Hemphill Street and it appearing to the Board of Comisssioners after a carefull consideration of the necessity and advantage of such improvements that curbings of the material and manner of construction , etc., as recommended by said report of Commissioner Davidson, should be made on each side of the said portion of the said Hemphill Street and it appearing to the Board of Commissioners that the enhancement in value of the property abutting on said street by the construction of the said curbing in front of said respective properties will be equal to or greater than the cost of the construction of the construction of the said improvements in front of the said respective properties. It is therefore hereby ordered by the Board of Commissioners that the ownersof property abutting on said portion of said street be and they are hereby called upon to construct the said curbings in front of the respective properties owned by them respectively save and except such pieces of property as are excepted from the recommendation made by said Commissioner Davidson on account of there al-ready being curbings in front of said pieces of property excepted of sufficient worth, value and usefullness to dispense with the necessity for further curbings in front of said properties. The said exceptions being shown by copy thereof recorded on the minutes as appear on page _________ and ______ ofBook of the minutes of the Board of Commissioners of the City of Fort Worth and it is further ordered that this order

[left margin] the said curb to be constructed according to the specifications referred to in said report and recorded on pages 226-227-228 and 229 of Book E of the ordinances as shown in Ordinance No. 16 and enacted by the Board of Commissioners of the City of Fort Worth not including said specifications and exceptions referred to.

published in the official newspaper of the City of Fort Worth once a day for ten consecutive days in order that any person owning property on said street in front of which by this order curbings is required to be constructed who may be unwilling to construct the same or pay his part of the cost of constructing said improvements in front of any property owned by him or her may file or cause to be filed his or her objection or portest thereto on or before the next regular weekly meeting of this Board of Commissioners held after the final publication of the order.

Provided that this order shall not be construed as to exempt any property owner who may own any of the property excepted as shown by said report of the Commissioner if it should be ascertained that the curbs in front of said excepted property is not of sufficient height-depth or durability as to constitute a curb necessary for said street nor in keeping with the character of curb called for by the same specifications herein referred to.

I hereby certify that the above order was presented and unanimously passed by the Board of Commissioners of the city of Fort Worth at session held September 3rd, 19o7.

A meeting of the Board of Commissioners of the City of Fort Worth is hereby called for 4 o'clock P. M. Sept. 30th, 1907 for the purpose of passing an ordinance making the tax levy for the year 1907.
