Kingston City Council Proceedings 1886-1894

In 1846 Kingston was incorporated as a city. There had from the beginning been considerable dissatisfaction with the original incorporation act. It had been felt that there were too few councilors, and there was no provision for proper assessment. After 1846 the council increased in size and the councilors were elected annually. The city limits were extended and the whole was divided into five wards: Cataraqui, Frontenac, Sydenham, Ontario and St. Lawrence. By the 1849 Baldwin Act, city limits were again increased and Rideau and Victoria wards were added. At that time the Council consisted of the mayor, fourteen aldermen and fourteen councilmen. In 1867 the Council was reduced to the mayor and twenty-one members, three from each ward, and all were called aldermen. The items to be described are two volumes of handwritten City Council minutes from 1886-1897. These minutes will be of particular value once transcribed as we have never received indices for 1880 to 1896. All other years are indexed making the information more findable.

Ald Meek introduced "A By Law to appoint two Trustees on the Kingston Collegiate Institute Board to fill the annual vacancies" which was read a first time. The 30th Rule was suspended and the Council went into Committee of the Whole on the second reading. Ald Behan in the Chair The Council resumed. The Committee rose and the Chairman reported the second reading of the By Law clause by clause. The Report was received. The 30th Rule was again suspended and the By Law was read a third time and passed.

Communications were read and referred as follows:

From James Agnew City Solicitor Re: Canadian Arbitrators fees - Arbitrations oopening up Sydenham Street. Fyled.

From Isaac Simpson President Cataraqui Bridge Co Annual Report and statements. Referred to the Committee on Finance &c

From John Marsh asking to be appointed Care taker of Parks. Referred to the Committee on Parks.

From T.W. Ness & Co Re: Fire Alarms. Referred to the Committee on Fire, Water and Light.

From Thomas Nicholson asking permission to erect and Ice house in rear of shop, corner of William and Ontario Streets.

On motion of Ald Meek seconded by Ald Allen Ordered, That the prayer of the petition of Thomas Nicholson be referred to the Mayor and City Commissioner.

On motion of Ald. Hardy seconded by Ald Gaskin. Ordered, That Aldermen McKelvey, Carson, McIntyre, Meek and Ryan and mover and seconder be a special committee to revise the order of procedure and rename the standing Committees and report to this meeting.

On motion, the Council adjourned for fifteen minutes.

The Council met pursuant to adjournment. All the members were present.

The Chairman from the Special Committee re: naming standing committees brought up a Report (Number 1149 Book G) which was read and adopted.

On motion of Ald McKelvey seconded by Ald Gaskin Ordered, That the following be a Committee to strike the standing Committees for the year viz Aldmn Behan, Horn, Meek, Gaskin, McIntyre, Wright and the mover and when the Council adjourns it stands adjourned until Thursday the 18th instant to receive report.

A meeting of the Council of the Corporation of the City of Kingston was held this day pursuant to adjournment. Present:

His Worship the Mayor Aldermen: Allen, Behan, Carson, Curtis, Elliott, Gaskin, Hardy, Horn, Martin, Meek, Mundell, McIntyre, McKelvey, McMahon, Richardson, C Robinson, W Robinson, Ryan, Skinner, Walkem, Wright

Ald Hardy introduced "A By Law to amend By Law No 447 with respect to the standing Committees of the Council" which was read a first time. The 30th Rule was suspended and the Council went into Committee of the Whole on the second reading. Ald Carson in the Chair The Council resumed. The Committee rose and the Chairman reported the second reading of the By Law clause by clause. The Report was received. The 30th Rule was again suspended and the By Law was read a third time and passed.

The Chairman from the Select Committee to strike the standing Committees for the year 1894 brought up a Report (Number 1148 Book G) which was read and adopted.

The Council resumed. The Committee rose and the Chairman reported the second reading of the By Law clause by clause. The Report was received. The 30th Rule was again suspended and the By Law was read a third time and passed.

From W. Phillips asking to be appinted caretaker of Parks. Referred to the Committee on Parks.

From Fife Fowler et al Taxes. Referred to the Court of Revision.

From George Johnston asking for the Statistics. Referred to the Finance Committee

From the House of Providence, by Ald Ryan asking for a grant. Referred to the Committee on Finance.

From the Hotel Dieu by Ald Ryan asking for a grant. Referred to the Finance Committee.

From Robert H Stevenson by Ald Gaskin Re taxes. Referred to the Court of Revision

From Charles Cunningham by Ald Mundell asking permission to sell on Market No 1. Referred to the Committee on City Property.

The Report of the Mayor and City Commissioners was read respecting application Thomas Nicholson Re: erection of Ice House.

On motion of Ald McIntyre seconded by Ald Meek Ordered, That the report of the Mayor and City Commissioners be referred to the Committee on Fire, Water and Light with instructions to report to this Council at its next meeting by By Law amending the existing Fire By Law as they may be advised.

The Portrait of the last Revd Father Dowd was presented to the Council. Referred to the Committee on City Property to accept same and draft suitable reply.

Ald Gaskin brought up for a second reading (read a first time December 4th 1893) A By Law to partially exempt from Municipal taxation the property of the Kingston Hosiery Company (Limited) in the City of Kingston for a period from the 31st day of December 1892 until the 31st day of December 1901 upon certain conditions.

In amendment to second reading Ald Elliott moves seconded by Ald Behan That the consideration of this By Law be laid over until next meeting of this Council which being put was lost.

Ald Behan moves seconded by Ald Carson That a By Law be prepared setting forth the general principles of exemption as adopted by the Council of 1892 and that the same be submitted to the electors the first time a by -law is voted on or at the next municipal Elections which being put was lost. On motion of Ald McKelvey seconded by Ald Gaskin Ordered, That when this Council adjourns it stands adjourned until Monday February the 5th unless the Mayor deems it necessary to call a meeting before that date.

Monday 8 o'Clock P.M. Kingston February 5th 1894

A Meeting of the Council of the Corporation of the City of Kingston was held this day. Present:

The Clerk read the minutes of the two last meetings.

The Mayor called the attention of the Council to the death of Alderman Eliott's Mother.

On motion of Ald Meek, seconded by Ald McIntyre Ordered, That this Council learns with deep regret of the death this day of Mrs R Elliott the belowed mother of Alderman R.F. Elliott closing a prolonged illness which she bore with Christian fortitude; that we condole with our respected colleague in his bereavement, the heaviest he can be called on to carry, and assure him of our sincere and abiding sympathy; and that a copy of this, our expression of regard be forwarded to Alderman Elliott by the City Clerk.

The Clerk submitted communications summarized which were referred as follows:

From I Gilbert account $3.00 alleged damage to delivery waggon and asking payment of same. Referred to the Board of Works.

From George Adsit, John Hartley and Alexander Duncan applying for the position of caretaker of Parks. Referred to the Committee on Parks.

From Mrs I.H. Gardiner asking to be relieved from the payment of street watering tax. Referred to the Board of Works.

From B.M. Britten Barrister claiming damages for injuries sustained by Miss Annie Ford caused by Barbed wire fence on Queen Street. Referred to the Board of Works.

From W.S. Gordon Secretary Local Board of Health asking the Council to unite with the Board to invite the Medical Health Officers of Ontario to hold their next meeting here. Referred to the Finance Committee with power to act.

From W.S. Gordon Secy L. B. of Health respecting regulations venders of milk. Referred to the Committee on Finance &c

From Smythe and Smith and others Re: Taxes. Referred to the Court of Revision.
