In 1846 Kingston was incorporated as a city. There had from the beginning been considerable dissatisfaction with the original incorporation act. It had been felt that there were too few councilors, and there was no provision for proper assessment. After 1846 the council increased in size and the councilors were elected annually. The city limits were extended and the whole was divided into five wards: Cataraqui, Frontenac, Sydenham, Ontario and St. Lawrence. By the 1849 Baldwin Act, city limits were again increased and Rideau and Victoria wards were added. At that time the Council consisted of the mayor, fourteen aldermen and fourteen councilmen. In 1867 the Council was reduced to the mayor and twenty-one members, three from each ward, and all were called aldermen. The items to be described are two volumes of handwritten City Council minutes from 1886-1897. These minutes will be of particular value once transcribed as we have never received indices for 1880 to 1896. All other years are indexed making the information more findable.

From B.W. Folger asking permission to extend their street Railway Track down King Stret to the Chown Foundry.

On motion of Ald McIntyre seconded by Ald Carson Ordered, That the permission asked by the Kingston Portsmouth and Cataraqui Company to lay a Railway track from Princess Street along King Street to the Chown & Cunningham Foundry peroperty be granted but subject to terms and conditions to be settled by this Council and that the communication be referred to the Board of Works to report to this Council and that this permission be not operative and no work on the street be done till a formal agreement satisfactory to this Council be executed by the Company and this Corporation.

Communications from James Agnew City Solicitor were read stating how the three cases in which the City was a party were disposed of and stating he received a letter from Mr. Clute stating there are good grounds for appeal in the case Kingston vs The Kingston C & P Railway Co.

Ald Carson moves seconded by Ald McIntyre That the City Solicitor be instructed to appeal from the Judgement of the trial the Judge rendered at the late sittings of the assizes here in the action by the City against The Kingston, Portsmouth & Cataraqui Street Railway Company in favor of the said company.

In amendment Ald Ryan moves seconded by Ald Behan That the communications from Mr Agnew be referred to the Board of Works which being put was lost and the original motion was carried. From the Montreal Transportation Company by Ald McKelvey asking permission to place two small piers in the harbor opposite the Tete du Pont Barracks.

On motion of Ald McKelvey seconded by Ald McIntyre Ordered, That the request of the Montreal Transportation Company for permission to place two small piers in the harbor opposite Tete du Pont Barracks be granted as far as this Council has power to grant such permission.

From The Mechanics Institute by Ald Curtis asking for a remission of taxes. Referred to the Court of Revision.

From John Fisher and others, by Ald McIntyre asking to have boulevard placed outside of Walk on south side of Johnston Street between Frontenac and Albert Streets. Referred to the Chairman of the Ward and the City Engineer.

From R Carson & others by Ald McIntyre asking that University Avenue to watered between Earl & Johnston Streets. Referred to the Board of Works.

From Captain William McKee by Ald Martin asking to have Johnston Street between University AVenue and the boundary line graded &c. Referred to the Board of Works.

From Robert Nesbett and 6 others by Ald Martin asking for a sewer on University Avenue from Brock to Johnson Street. Referred to the Board of Works

Works and the City Commissioner.

From W. Smallridge and 2 others by Ald Horn asking permission to move the board walk out on the west side of Earl Street between Gordon and Alfred street at their expense &c. Referred to the Chairman of the Ward and the City Engineer.

From Canton Kingston J.O.O.F. by Ald Elliott asking for permission to use Ontario Hall for practice one evening each week.

On motion of Ald Elliott seconded by Ald Allen Ordered, That the petition be referred to the Committee on City Property with power to act and that the same priviledge be granted to the Hibernians as is granted to the J.O.O.F.

Ald McIntyre introduced a By Law entited "A By Law to adopt for the year 1894 the assessment of the Municipality of the City of Kingston of Kingston made in the year 1893 under the provisions of Section 32 of the Consolidated assessment Act of 1892 and of the By Law No 459 passed under the authority of said section" which was read a first time The 30th Rule was suspended and the Council went into Committee of the Whole on the second reading. Ald McKelvey in the Chair. The Council resumed. The Committee rose and the Chairman reported the second reading of the By Law clause by clause. The Report was received. The 30th Rule was again suspended and the By Law was read a third time and passed.

Ald McKelvey from the Finance Committee presented Report No 4 (1176 Book G) read previously on the 2nd and 9th of April respectively.

Ald McKelvey moves seconded by Ald McIntyre That the report of the Finance Committee No 4 received by the Council April 2nd 1894 be adopted.

The Council proceeded to take up report from hwere left off at last meeting clause by clause.

In amendment to 4th clause Ald Meek moves seconded by Ald Hardy That clause 4 of the Report of Committee on Finance be amended by striking out all after the word "that" and inserting with the permission of the Police Commissioners the duties of the City Commissioners and of Secretary of the Board of Health be transferred to the Chief of Police who shall receive the salary recommended by the Finance Committee in their report of the second of April and that Mr Gordon be assessor and auditor of City Accounts, his remuneration to be $1000.00 per year and his duties defined by by law to be passed by this Council which being put was carried. In amendment Ald Ryan moves seconded by Ald Behan That $100 be granted to the Orphans Home, $100 to the House of Providence and $200 to the Hotel Dieu Hospital which being put was lost. In amendment 1st Ald Behan moves seconded by Ald Allen That Rule 42 be suspended and that the Report of the Committee on Fire, Water, and Light be now considered.

In amendment 2nd Ald Elliott moves seconded by Ald G.W. Robinson That this Council do now adjourn and a special meeting be called the latter part of the present week.

In amendment 3rd Ald Carson moves seconded by Ald Meek That the 42nd Rule be suspended and that the Council take up the report of the Board of Works and the report of the Fire, Water and Light be taken up before the Budget be introduced which being put was lost as were also the first and second amendments and the original motion was carried. In amendment to clause Collector's Salary in Budget Ald Meek moves seconded by Ald Elliott That the Collector of Taxes be paid by per centage on his collections as follows: On the amount paid to him between the time the rolls of 1894 are placed in his hands and November 1st one half percent; on the amount paid to him between November 1st and February 1st two percent; on the amount paid him between February 1st and April 1st one and a half percent; and on the amount paid to him between April 1st and the time the rolls are returned, one percent which being put was carried.

Ald McKelvey introduced a By law to levy a rate of 17-1/2 mills on the dollar upon the assessed value of the rateable property in the Municipality of the City of Kingston for the lawful purposes of the Municipality for the year 1894 which was read a first time. The 30th Rule was suspended and the Council went into Committee of the Whole on the second reading. Ald Richardson in the Chair. The Council resumed. The Committee rose and the Chairman reported the second reading of the By Law clause.

The report was received. The 30th Rule was again suspended and the By Law was read a third time and passed.

The Chairman from the Board of Works brought up a Report (Number 1179 Book G) which was read and he submitted Report of the City Engineer Re: Local Improvement Sewer on Montreal Street from James to Charles Street with estimate of same.

On motion of Ald Carson seconded by Ald Meek Ordered, That the Report of the Board of Works be received and adopted.

On motion the Council adjourned at 1/4 to 3 o'Clock A.M.

A Special Meeting of the Council of the Corporation of the City of Kingston was held this day. Present:

Aldermen: Allen, Behan, Carson, Elliott, Hardy, Horn, Meek, Mundell, McIntyre, McKelvey, McMahon, Richardson, G Robinson

Ald McKelvey was chosen Chairman

The meeting was called to consider agreement Street Railway Company Re: track on King Street and general business.

Communications summarized were read as follows

From James Agnew City Solicitor Re;Bills having passed Legislature and stating the case Angove vs Kingston was dismissed without costs. Filed.

Ald Carson brought up the petition of J.B. Cook and 29 others asking to have Montreal Street watered between Picard and Charles Street. Referred to the Board of Works.

On motion of Ald Carson seconded by Ald McIntyre Ordered, That this Corporation do hereby agree to make and while the tramway is used by this Corporation maintain perfectly safe plank crossings level with the grade of the streets so as to be no impediment to traffic said crossings to be satisfactory to the Council of the Village of Portsmouth and when said tramway is removed make the road bed where disturbed into as good condition as before and this coporation also undertake to save the village of Portsmouth harmless from any claims for damages arising from said track being so placed.

The Chairman from the Board of Works brought up Reports No 1 & 2 (Number 1180 which were read.

On motion of Ald Carson seconded by Ald Meek Ordered, That the report of the Board of Works No 1 be received and adopted and discussed clause by clause.
