submitted us the report of the sub-committee appointed to estimate the amount which will be due this Corporation from the Massachusetts Horticultural Society, according to the provisions of the indenture just adopted, an account stating the several items of debit and credit, from which it appeared that the amount^which will be due from said Horticultural Society, is nine thousand and eight & 49/100 dollars.

Voted that said report be accepted and placed on file.

Upon motion by Mr Read

Stone Farm Annexed.

Voted that all land owned by the Proprietors of the Cemetery of Mount Auburn, situated on the southerly side of their Cemetery be, and the same hereby are, annexed to said Cemetery, and made part thereof.

Voted that the Superintendent be directed to cause one or more interments to be made on said lands,

Voted that the Secretary be directed to send a copy of these votes to the Assessors of Watertown.

The meeting was then adjourned. Attest Austin J. Coolidge Secretary.

A meeting of the Trustees was held according to adjournment at the usual place, on

There were present the President, Messrs Andrews, Cheever, Crocker, Curtis, Gould, Little, Nazro, Read and Tobey. 10 ~

President's Annual Rept

The President read the Annual Report of the Trustees; and it was voted that the same be accepted, printed and distributed to the Proprietors at their Annual Meeting.

Report of Com. on Grounds.

The President also for the Committee on the Grounds submitted a report, stating the improvements that had been made during the season, under the appropriation of .

Voted that the same be accepted & placed on file.

Treasurer's Report

The Treasurer read his Annual Report, together with that of the Superintendent.

Upon motion by Mr Tobey the same were accepted and ordered to be printed, with the Trustees' Report.

Fund for Repairs

The Treasurer also read a paper stating the value of Accounts in the Fund for Repairs on .

Voted that the same be accepted and placed on file.

Additional Appropriation for Lots 661, 1080, 1081

A letter from Mace Tisdale Esq. addressed to the Trustees, _ in which he offered to add five hundred dollars to the amount which now stands to the credit of himself and S K. Hewins in the Fund for Repairs, for the perpetual care and preservation of lots 661, 1080 & 1081, and the ornamental grounds connected with the same, upon the trusts and for the purposes mentioned in said letter _ was read.

And it was thereupon

Voted that said sum be and is hereby accepted, upon the conditions and trusts contained in his said letter. [see copy of letter in Record of Donations &c.]

Conveyance to Heirs at Law & others

The Secretary stated that many cases of embarrassment had occurred, and were likely to occur frequently for the reason that the charter confers upon this Corporation no power to convey lots to the heirs at law and other persons taking the estate of any deceased person, to hold the same in common. It was therefore, upon motion by Mr Curtis,

Voted that a Committee of three be chosen to apply to the General Court of this Commonwealth for an act in addition to the act incorporating the Proprietors of the Cemetery of Mount Auburn, which shall authorize the conveyance of lots by this Corporation to the heirs at law, executors, trustees or others who may be authorized under the will of any deceased person to hold the same in common in the same manner as other lots are held, subject however to the operation of Article Eight in respect to the representation of lots of deceased proprietors.

Upon nomination by the Chair. Messrs Curtis, Nazro and Sleeper were appointed such Committee.

Annual Meeting _

Voted that the Secretary be authorized to procure a place for the Annual Meeting.

Report on Vote of Props at last Annual Meeting _

That the Trustees feel bound to receive with respectful attention all suggestions coming from the Proprietors; but that it is impossible for them to keep in proper order an aggregate of nearly three thousand private lots, which number is constantly increasing; and at the same time to pay the necessary expenses of the Cemetery, without consuming more than their whole income, and frustrating the purposes of the permanent fund, which they have covenanted with their new proprietors to increase and keep inviolate. Besides which, the Committee have doubts whether

the Trustees would have any right to enter and repair, or otherwise alter, the lots of proprietors, without the consent and specific instructions of each proprietor to that effect.

The foregoing report was read and it was Voted unanimously that the same be accepted & filed. _

Supply of Water _

Mr Curtis for the Special Committee chosen in February last respecting obtaining a supply of water for Mount Auburn from the Cambridge Water Works, stated that the Committee are not yet prepared to make any report, and he moved, and it was

Voted that the subject be referred to the next board of Trustees.

Harvard College Lots _

The Committee to whom was referred the memorial of Mr Lawrence, Treasurer of Harvard College, respecting the boundaries of the lot in the Cemetery belonging to that Corporation _ with full power _

Reported that they had arranged with the Treasurer of the College that said lot should be surveyed, and that it should be optional with him whether the monuments now said to encroach upon the lands of this Corporation should be removed within the present bounds, or whether sufficient land should be exchanged from another part
