Referring to your letter of 23 Feb'y, '06, the Board has the honor to enclose herewith the letter of 18 Jan'y, '06, to yourself from Mr. D.J. Maher, of Portland, Oregon, relative to purchasing or leasing the lighthouse site on Yaquina Bay, Oregon.

MAILED APR 20 1900

Dear Sir: I have the honor to acknowledge the reciept of your letter of 23d ultimo, inclosing correspondence in relationto an inquiry from Mr. Dan. J. Maher, Clerk of the Port of Portland Commission, Portland, Oregon, relative to the status of certain land known as the Light House Reservation at Yaquina Bay, Oregon. Replying thereto I beg to inform you that this reservation, comprising about thirty-six acres, was, by authority of the Secretary of the Treasury dates October 24, 1888, transferred by the Light House Board to the engineer officer in charge of the improvement of Yaquina Bay for temporary use of the War Department, with the understanding that when no longer used by the said Department, or whenever required by the Board, the reservation and buildings should revert to the care of hte Light House Establishment. As it appears from a report of the local engineer officer, Major Roessler, that the improvement of Yaquina Bay has been discontinued, the Department of Commerce and Labor has been informed that as the War Department has no present

use for the reservation, there is no objection to the Light House Establishment assuming possession and control thereof. All the papers in the case have been transmitted to the Department of Commerce and Labor, and Mr. Maher should be advised to correspond with that Department regarding further disposition of the property. Sir:

Referring again to your letter of April 20, 1906, inquiring as to whether the lighthouse reservation on Yaquina Bay, Oregon, could be acquired by private parties I have the honor to state that this lighthouse reservation being needed for life-saving purposes was on May 12, 1906, turned over to the Treasury Department for the use of the Life-Saving Service.

Department of Commerce and Labor OFFICE OF THE SECRETARY Washington

May 12, 1906.

The Honorable, The Secretary of the Treasure, Sir:

This Department has the honor to acknowledge the receipt of Treasury Department letter of May 3, 1906, No. L.R. 928119, asking permission for the Life-Saving Service to occupy the light-house reservation at Yaquina Bay, Oregon, for life-saving purposes, and further asking for the use of the buildings now there, by the Life Saving Service.

In reply this Department states that this matter was considered by the Light-House Board at its session on May 7, 1906, when it decided that it had no objection to the use of this lighthouse reservation and buildings thereon as a life-saving station.

This Department concurs in the Board's decision, and authorizes the use of this Light-House reservation and its buildings by the Life-Saving Service, in the manner requested under such conditions as may be prescribed by the Engineer of the 13th Light-House District, and with the understanding that should this site be needed again for Light-House purposes this permission may be revoked by this Department.
