22 Tuesday Was windy and cold in morning Went to Court -- Judge Eccleston present. Commenced case of Harlan vs Carter -- Jury empannelled. Patent and deed read -- plats explained to jury commenced evidence -

23rd Court met. Adjourned to next Monday on motion of O. Scott Esq. on account of death of Bishop Ecclestons brother of the Judge weather more pleasant and settled

Continued Wednesday 23rd April O. Scott addressed the court as follows Information having reached us of the death of Archbishop Eccleston and from the intimate manner in which he is connected with your Honor as well as from the high position he occupies in society I move on the part of the bar that the Court be adjourned over to Monday next to give your Honor and others allowing Court an opportunity of attending the funeral Judge Eccleston replied that he was gratified to receive this expression on part of the bar, that afflictions of late had fallen heavily around him, that since the decease of his brother he was now the only survivor of his fathers family, and that

he was thereby strongly admon ished that his days were draw ing to a close. He would ac cept the motion of the Bar and adjourn to Monday, although he regretted as much as any man could the delay in the business of the court. - Came home at noon and wrote a deed for Charles Biler worked in shop at banding hubs -- Weather becoming more favorable

April 25th continued Robert Carter appears to be failing rapidly -- was shown a bolt in a rock by Henry Carter which he said was the height to which the water of G.P. Mills was to be raised by their dam said bolt bears from stone south of S. O. N 86 3/4 E 4.7 per and from large Chesnut on west margin of Creek S 60 1/2 E 1.3 perches The rock in which the bolt is inserted lies in the west margin of the Creek and has a shattered and vexing appearance on top -- the bolt is of round iron about one inch in diameter and stands about 1/4 of an inch above the surface of the rock -- Joseph Miller was present

Went early in morning to Geo. Grant's 2 miles beyond Dysart's, surveyed for him an acre lot and wrote Deed -- Quarterly meeting at New Leeds -- Mr Shriner preached at night

----- 29 ---- Attended Court. John S. Moffitt died this morning. Saw Dr Carter who informed me that Sister Martha was sick
